Terms & Conditions

When purchasing services from Fab Web Media (fabwebmedia.com), you as the client must agree to the following terms & conditions.

Payments

All online payments are accepted via PayPal for the client's protection as well as ours. An initial 50% deposit must made before we being working on the client's project. The remaining balance is due at the completion of the project, after the client has approved the design and before we make the final delivery.

For projects under $100, Fab Web Media requires 100% total cost be paid before the start of the client's project.

All major credit cards (Visa, Mastercard, American Express) and e-checks are processed by PayPal for the client's convenience, and the client does not need to have a PayPal account.

Communication & Support

During the two-week idea and design process, all communication will be made via email, or by phone for clarification purposes. The client or a representative must be able to correspond via email to provide any ideas and to expedite the design process.

After final delivery of the client's website or blog (if applicable), Fab Web Media will answer general technical support questions and perform basic maintanence at the client's request for a six (6) week period. Hourly or monthly service fees will be discussed with the client beyond the stipulations of basic support and maintanence.

Permissions & Authorization

For SEO and web design services, the client authorizes Fab Web Media to access the necessary FTP server and/or blogging account to administer our services. The client will need to provide Fab Web Media with the necessary password or temporary password needed to access the account.

Ownership

Once the final delivery has been made, all ownership of custom graphics and design will be transferred to the client. All code infrastructure will remain copyright to Fab Web Media or its respective creator.

Liability

Any service purchased from Fab Web Media is provided "as is" without warranty of any kind that the design project will be uninterrupted or error-free. In no event will Fab Web Media be liable to you or any third party, on any legal theory for any direct, indirect, special, incidental, punitive, exemplary or consequential damages arising out of the use of any Fab Web Media service, graphic, or code, or the use of any hosting service, service provider, telecommunications carrier, internet services, third pary e-commerce programs, or your site visitor's computer or internet software, including without limitation, service interruptions caused by Acts of God and/or Nature, or any other circumstances beyond our reasonable control, any lost profits, business interruption, loss of data or otherwise, even if expressly advised of the possibility of such damages.
